Fair Use Policy

To ensure fair and reliable network performance for all users in Vanuatu, all Sky5G Vanuatu internet services are subject to this Fair Use Policy. This policy supports equitable access to network resources and compliance with local laws and telecommunications regulations. 

  1. What “Fair Use” Means

While Sky5G Vanuatu offers generous or unlimited data plans, customers are expected to use the service responsibly and in a way that does not negatively affect other users or network performance. 

Unfair or unreasonable use includes (but is not limited to): 

  • Excessive or disproportionate consumption of bandwidth compared to average users in similar plans. 
  • Continuous automated or unattended data usage, such as servers, mining, or constant high-volume uploads/downloads. 
  • Malicious or abusive activity, including spam, hacking attempts, or hosting harmful content. 

Sky5G reserves the right to determine what constitutes unreasonable use in the context of Vanuatu’s shared network capacity and rural connectivity standards. 

  1. Unlimited Plans

“Unlimited” means there is no fixed data cap for normal, personal, or business use within reasonable limits. It does not mean unlimited use without consideration for network impact. 

If your usage is significantly higher than typical customers or is found to degrade service quality for others, Sky5G Vanuatu may: 

  • Contact you to discuss your data patterns. 
  • Recommend a more suitable plan. 
  • Request that you modify your usage behaviour. 
  • In rare or severe cases, throttle, suspend, or terminate the service to protect network integrity. 
  1. Prohibited Uses

You must not use your Sky5G Vanuatu service to: 

  • Send unsolicited messages, spam, or mass emails. 
  • Host, distribute, or share illegal, offensive, or prohibited content under Vanuatu law. 
  • Attempt to interfere with, disrupt, or gain unauthorised access to other networks or systems. 
  • Engage in any activity that violates intellectual property rights, including copyright infringement. 
  • Operate high-demand commercial or data-centre-style services that are not approved under your service plan. 
  1. Monitoring and Enforcement

Sky5G Vanuatu monitors network usage to maintain reliable service for all customers. Monitoring focuses on data patterns, not content, and is conducted in accordance with privacy principles and the Sky5G Vanuatu Privacy Policy. 

If we detect activity inconsistent with this policy, we will normally: 

  1. Attempt to contact you to discuss the issue; 
  1. Provide advice or options to correct it; 
  1. Take further action if necessary to protect service quality for others. 

Severe, deliberate, or repeated breaches may lead to service restriction, suspension, or disconnection in accordance with the Sky5G Vanuatu Terms and Conditions. 

  1. Legal and Regulatory Compliance

This Fair Use Policy forms part of Sky5G Vanuatu’s Terms and Conditions. By using our services, you agree to comply with it. 

Sky5G Vanuatu operates under the oversight of the Telecommunications, Radiocommunications and Broadcasting Regulator (TRBR) and complies with applicable laws of the Republic of Vanuatu regarding network use, content standards, and telecommunications practices.
